Terms of service

1. Purpose

These terms govern access to and subscription to the Erganos service ("the Service"), published by the company identified in the legal notice ("Erganos"). Signing up constitutes acceptance of these terms.

2. Description of the Service

Erganos provides "AI employees": software assistants that prepare and, depending on the configuration chosen by the Customer, carry out tasks on their behalf — social media posts, invoice reminders, support e-mail replies, missed-call text-backs.

By default, every message or post addressed to a third party requires the Customer's approval. The Customer may extend the autonomy of their AI employees; in all cases they remain editorially responsible for content sent in their name. In accordance with applicable regulations, AI employees introduce themselves to third parties as artificial intelligences.

3. Account and trial period

The Service is for business use only (B2B). The Customer warrants the accuracy of the information provided at sign-up.

Each AI employee can be tried free of charge for 14 days, with no payment method required. At the end of the trial, the employee stops working until confirmed (paid subscription).

4. Prices and billing

The price is €79 per month for the first confirmed AI employee and €59 per month for each additional one. VAT arrangements are specified at checkout.

Billing is monthly, operated by our payment provider Stripe. The number of confirmed employees determines the billed quantity; any mid-month change is prorated.

5. Term and cancellation

The subscription is monthly, without commitment, tacitly renewed. The Customer may cancel at any time from their billing portal; cancellation takes effect at the end of the current period, without pro-rata refund.

Upon account closure, the Customer's data is deleted as described in the privacy policy.

6. Customer obligations

The Customer agrees to use the Service lawfully, and in particular to: refrain from unlawful prospecting or spam; honour recipients' opt-out rights; provide accurate information to the AI employees; and not attempt to circumvent the Service's security or approval mechanisms.

7. Liability

Erganos is bound by an obligation of means. The Service is provided "as is"; Erganos does not guarantee uninterrupted operation or the accuracy of generated content, which the Customer must review before publication whenever it is submitted for approval.

Erganos' total liability, on any grounds, is capped at the amounts actually paid by the Customer over the previous twelve months. Indirect damages (loss of revenue, customers or data) are excluded.

8. Personal data

Personal data processing is described in the privacy policy. For data the Customer entrusts to the AI employees (their own customers' contact details, invoices, messages), Erganos acts as a processor under the data processing agreement (DPA).

9. Changes to these terms

Erganos may update these terms. The Customer is informed of any substantial change at least thirty days before it takes effect; continued use of the Service constitutes acceptance.

10. Governing law

These terms are governed by French law. In the event of a dispute and failing an amicable settlement, jurisdiction is granted to the courts of Erganos' registered office. The French version of these terms prevails.
